NEW Article 50 Upgrade Forms
The BMIBundesministerium für Inneres The Bundesministerium für Inneres (BMI) / Ministry for the Interior (UK counterparty: the Home Office) is competent for public security, policing, border control as well as residency and citizenships. It is also responsible for elections and direct democracy instruments as well as the civil service in the respective provinces, as well as municipal level where they are not covered by the Federal Chancellery. have now published on their Brexit site dedicated “upgrade” forms. These should be used if you plan on upgrading to permanent residence (10 year card).
These can be found in the “Daueraufenthaltsrecht nach dem Austrittsabkommen” section of the BMI German Brexit site and also under the “Permanent right of residence according to the Withdrawal AgreementWithdrawal Agreement The Withdrawal Agreement sets out the terms of the UK’s withdrawal from the EU and provides for a deal on citizens’ rights. It sets out a transition period which lasts until 31 December 2020. During this time you can continue to live, work and study in the EU broadly as you did before 31 January 2020. If you are resident in Austria at the end of the transition period, you will be covered by the Withdrawal Agreement, and your rights will be protected for as long as you remain resident in Austria. New Standard Article 50 Forms
There are now some NEW standard Article 50 forms (non-upgrade version) which should be used for family re-unification (e.g. new babies) and extensions of the standard 5 year cards.
If you know that you will not get permanent residency (e.g. significant health insurance gaps), then you may be advised to use these forms or may be asked to comlete them:

Where to make your appointment:
Outside of Vienna you should make your appointment at your local Bezirkshauptmannschaft, or Magistrat in larger cities. In Vienna, please check the following update.

Bestätigung über die Antragstellung
At the appointment, you should be provided with a “Bestätigung über die Antragstellung” (Confirmation of Application). This may not be necessary if your existing card has a long validity (e.g. more than 3 months).
