Starting with the Austrian Websites where relevant (mostly German), followed by the actual Withdrawal AgreementWithdrawal Agreement The Withdrawal Agreement sets out the terms of the UK’s withdrawal from the EU and provides for a deal on citizens’ rights. It sets out a transition period which lasts until 31 December 2020. During this time you can continue to live, work and study in the EU broadly as you did before 31 January 2020.   If you are resident in Austria at the end of the transition period, you will be covered by the Withdrawal Agreement, and your rights will be protected for as long as you remain resident in Austria.   Any rights that are not covered by the Withdrawal Agreement will be the subject of future negotiations.   https://www.gov.uk/government/publications/new-withdrawal-agreement-and-political-declaration   texts (in English and German) and then the Austrian Law text (in German)

There are only a few sources which state which card, either the normal residency (5-year validity) or the permanent residency (10-year validity) card you will receive, but basically the distinction is clear.

If you have lived in Austria for :

  • less than 5 years, then (with a few exceptions) you can only be issued with the normal residency (5-year) card.
  • over 5 years:
    • if you can show you have at any time had 5 continuous years of legal residence, then you have earned your right to permanent residency and you will be issued with a permanent residency (10-year) card.
    • If you cannot provide that evidence, then you should be issued with only the 5-year card. (though you might be lucky)
  • If you already hold a Bescheinigung des DaueraufenthaltsBescheinigung des Daueraufenthalts für EWR Bürger This is the document you can apply for after 5 years' continuous and legal residency in Austria. It confirms that you have the right to permanent residency under EU rules as an EU citizen. It requires you to provide proof of residency, employment or sufficient financial resources, and all-risks medical and health insurance cover. Holders of this document are guaranteed the Article 50 EUV card via a quick and easy process in 2021. Note: British Citizens could only apply for the Bescheinigung des Daueraufenthalts until the end of the transition period (31.12.2020), or an older similar unrestricted permit from before 1995, then you will be issued with a 10-year card (with only a few checks). These documents prove you have already earned permanent residency statuus. The new card will be free of charge.

Withdrawal Agreement extracts:

The Withdrawal Agreement [2019/C 384 I/01] is a joint EU/UK agreement with direct action, which means it has legal precedence over any existing or missing national laws. It basically trumps Austrian law. It is based heavily on the original European Union Freedom of Movement Directive [Directive 2004/38/EC].

RIGHTS RELATED TO RESIDENCE, RESIDENCE DOCUMENTS

Article 15

Right of permanent residence

1.   Union citizens and United Kingdom nationals, and their respective family members, who have resided legally in the host State in accordance with Union law for a continuous period of 5 years or for the period specified in Article 17 of Directive 2004/38/EC, shall have the right to reside permanently in the host State under the conditions set out in Articles 16, 17 and 18 of Directive 2004/38/EC. Periods of legal residence or work in accordance with Union law before and after the end of the transition periodTransition Period The transition period (also referred to as the implementation period) is the period following the UK's departure from the European Union (on 31.01.2020) until the end of 2020. An option to extend this period has not been taken up by the UK government. shall be included in the calculation of the qualifying period necessary for acquisition of the right of permanent residence.

2.   Continuity of residence for the purposes of acquisition of the right of permanent residence shall be determined in accordance with Article 16(3) and Article 21 of Directive 2004/38/EC.

3.   Once acquired, the right of permanent residence shall be lost only through absence from the host State for a period exceeding 5 consecutive years.

Artikel 15

Recht auf DaueraufenthaltDaueraufenthalt Daueraufenthalt simply means permanent residence. If you have permanent residence rights, usually from having been legally resident for 5 years, you are eligible for a 10 year residency permit.

Ausstellung von Aufenthaltsdokumenten

(1) 

h)Personen, die vor Ende des Übergangszeitraums ein nach Artikel 19 oder 20 der Richtlinie 2004/38/EG ausgestelltes gültiges Daueraufenthaltsdokument besitzen oder ein gültiges inländisches Einwanderungsdokument besitzen, das ein dauerhaftes Recht auf Aufenthalt im Aufnahmestaat verleiht, haben das Recht, dieses Dokument innerhalb des unter Buchstabe b des vorliegenden Absatzes genannten Zeitraums auf Antrag nach einer Überprüfung ihrer Identität, einer Strafregister- und Sicherheitsüberprüfung nach Buchstabe p des vorliegenden Absatzes und der Bestätigung ihres andauernden Aufenthalts gegen ein neues Aufenthaltsdokument umzutauschen; dieses neue Aufenthaltsdokument wird unentgeltlich ausgestellt.

Form, Inhalt und Gültigkeitsdauer des Aufenthaltstitels „Artikel 50 EUV“

§ 6.

(4) Der Aufenthaltstitel wird mit einer Gültigkeitsdauer von fünf Jahren ausgestellt. Hat der Fremde bereits das Recht auf Daueraufenthalt (Art. 15 des Austrittsabkommens) erworben, wird der Aufenthaltstitel mit einer Gültigkeitsdauer von zehn Jahren ausgestellt.
